These theories include: fault theory, risk theory, warranty theory, complex theory and theory of agency among which the first three ones are the most significant ones. The main and key question raised about this issue is that which one of these theories should be considered as the basis on which the journalists civil liability is established. This question as well as the conditions and principles of the press and the journalists have to be studied and investigated based on legal obligations and regulations. Those involved in the journalism have high potentials for ignoring the rights of the public or the losses sustained to them. Laws and regulations should be enacted based on the current situation and researches and studies should be carried out and legal principles should be developed in order to reduce this potential as much as possible and to safeguard the rights of the public or to identify the person who is liable and deserves to compensate for the losses, taking the fundamentals of the media liability into consideration and to choose the suitable option for the kind of compensation in the press domain and the losses sustained, investigating the compensation options, so that the sustained losses will be compensated to the extent possible. On the other hand , the media law and freedom of the press should be taken into consideration to enable the press to fulfill their duties and obligations by exercising their rights and powers and to avoid the obstructions for their performance.
