The common act that is expected of no-fault contract party has no contradictionwith the obligation of the other party and sometimesdue to the cancellation orbreach of contract in which the other party is included, there is no obligation andbeing obligated to it is not possible. Despite the responsibility of contract party,the no-fault party should take the measurement even by acting the requiredsubject. Sometimes the contracts and obligations are enforced but the actexpected by no-fault has no contradiction with the obligation subject. The common act expected by no-fault is performing the obligation thing of the otherparty. The present study after the investigation of damage coping rules andperforming obligation thing reviews the common law system and Iran law and byconsidering the condition of conditions stipulated in contract of non-responsibility, its various dimensions are explained and the role of conditionsstipulated in contract is recognized as the solution of contradictions of variousrules
