The discussed legal rules is ambiguous and synopsis because of abbreviation ,so many different concepts is presented in this relation. Another problem of this legal rule is weak document of this rule ,because the only document of this rule is a prophetic hadith without validity in terms of authenticity and narrators. Applicable and updated rules are the basic of civil liability that is very important according to economic and politic conditions. Moreover ,this paper verify the legal rule in terms of substances ,concepts and research documents and explain the civil liability of government based on rules,errors and differences of this rule with the basic of civil liability.
